Reimbursement and Readjustment of Private Health Insurance Premium
A client came to our law firm after her private health insurance company increased her monthly premium by nearly 85%, creating a disproportionate and unjustified financial burden. In response, we filed an amparo action, which ultimately resulted in a favorable judgment.
As a result, the health insurance company must readjust the monthly premium to ARS 120,000, whereas before the judgment was issued, the member had been paying ARS 189,000. This means that our client will now pay ARS 69,000 less per month, representing an approximate 36.5% reduction from the amount she had been paying.
In addition, the company must reimburse her nearly ARS 2,000,000 for the amounts that were wrongfully charged.
This case shows that, in the face of excessive or arbitrary increases, there are legal remedies available to protect members’ rights and to seek both an adjustment of the premium and reimbursement of the overpaid amounts.
